Terms & Conditions

Welcome to Lily Clare Art & Design. These Terms & Conditions govern your use of our website and the purchase of products from us. By placing an order, you agree to these terms.

1. About Us

Lily Clare Art & Design is an independent UK art business creating original artwork, limited edition fine art prints, bespoke pet portrait commissions and art-inspired gifts.

Throughout these Terms, "we", "our" and "us" refer to Lily Clare Art & Design.

2. Products

Every piece of artwork begins as an original hand-created illustration or painting.

We make every effort to display colours accurately. However, colours may vary slightly depending on your monitor or device settings.

As many products are handmade or produced in small batches, slight variations may occur. These variations are part of the character and uniqueness of handcrafted products.

3. Original Artwork

Original artworks are one-of-a-kind.

Once sold, they will not be recreated as another original.

Where applicable, original artworks are supplied with a Certificate of Authenticity.

Ownership of the physical artwork transfers to the purchaser upon full payment.

Copyright remains with Lily Clare Art & Design.

4. Limited Edition Prints

Limited edition giclée prints are produced in strictly limited quantities.

Each print is individually signed and numbered by the artist.

Where stated, a Certificate of Authenticity is included.

Once an edition has sold out, no further prints from that edition will be produced.

5. Pet Portrait Commissions

Commissioned artwork is created specifically for each customer.

A non-refundable deposit of 50% is required before work begins.

Work will not commence until both the deposit and suitable reference photographs have been received.

The remaining balance must be paid before the completed artwork is dispatched.

As commissioned artwork is personalised, it cannot be cancelled once work has started except where required by law.

Completion times vary depending on workload and complexity. Estimated completion dates will be discussed before work begins.

6. Prices

All prices are displayed in Pounds Sterling (£ GBP).

Prices may change without notice but will never affect orders already confirmed.

Shipping costs are calculated separately at checkout.

7. Payment

Payment must be received in full before goods are dispatched (except commissioned work where deposits apply).

Payments are processed securely using the payment providers available on our website.

We never store your payment details.

8. Shipping & Delivery

Shipping times are estimates only.

Although we aim to dispatch within the stated timescales, delays outside our control (including courier delays, customs processing or severe weather) cannot be guaranteed.

9. International Orders

Customers outside the UK are responsible for any customs duties, import taxes or local charges that may apply.

Lily Clare Art & Design cannot be held responsible for these charges.

10. Returns & Refunds

Under the Consumer Contracts Regulations, customers may cancel eligible purchases within 14 days of receiving their goods.

Items must be returned unused and in their original condition.

The following items are non-returnable unless faulty:

  • Commissioned artwork

  • Personalised products

  • Gift vouchers

  • Digital downloads (if applicable)

This does not affect your statutory rights.

11. Damaged or Incorrect Items

If your order arrives damaged or incorrect, please contact us within 48 hours of delivery.

Please provide:

  • your order number

  • photographs of the item

  • photographs of the packaging

  • photographs of the shipping label

We will resolve the issue as quickly as possible.

12. Intellectual Property & Copyright

All artwork, illustrations, photographs, product designs, logos, text and website content remain the intellectual property of Lily Clare Art & Design.

Purchasing artwork does not transfer copyright.

Artwork may not be:

  • reproduced

  • scanned

  • copied

  • distributed

  • modified

  • used commercially

without prior written permission.

This applies to both original artwork and commissioned portraits.

13. Image Usage

Unless otherwise agreed in writing, Lily Clare Art & Design reserves the right to photograph and display completed commissioned artwork for use in:

  • portfolio

  • website

  • exhibitions

  • social media

  • marketing materials

If you would prefer your commission to remain private, please let us know before work begins.

14. Website Accuracy

We aim to ensure all information on this website is accurate.

However, we reserve the right to correct errors relating to pricing, descriptions or availability without prior notice.

15. Gift Vouchers

Gift vouchers:

  • cannot be exchanged for cash

  • are non-refundable

  • must be redeemed before the expiry date (if applicable)

16. Limitation of Liability

To the fullest extent permitted by law, Lily Clare Art & Design shall not be liable for indirect or consequential losses arising from the purchase or use of our products or website.

Nothing within these Terms limits your statutory consumer rights.

17. Privacy

Your privacy is important to us.

Please refer to our Privacy Policy for information about how we collect and use your personal information.

18. Changes to These Terms

We reserve the right to update these Terms & Conditions at any time.

The latest version will always appear on this website.

19. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the English courts.
